Alleged sexual assault: Lagos medical doctor, Olaleye opens defence

Lagos-based medical doctor, Olufemi Olaleye, yesterday, opened his defence before Lagos Sexual Offences and Domestic Violence Court, in alleged defilement case involving his 16-year-old wife’s niece.
 
The director of  Cancer Care Foundation is facing a two-count charge of defilement and sexual assault by penetration, which he is alleged to have committed between March 2020 and November 2021. In December, he pleaded not guilty to the charges.
   
At the resumed hearing of the case, Olaleye, opened his defence with the first defendant’s witness, Dr. Uwom Eze, who testified before Justice Ramon Oshodi.
 
Led-in-evidence by the defence counsel, Mr. Olusegun Fabunmi (SAN), the witness, a forensic pathologist and clinical forensic physician, said there was no evidence that the survivor was defiled four times.
   

He also said there was no indication that oral sex took place in the sexual penetration allegation
   
The witness gave evidence based on the medical report presented to the court by the prosecution’s witness, Dr. Oyebimpe Akinbunmi, who testified on January 26,2023.
     
Eze, a  head of Forensic Medicine Unit, Department of Pathology, University College Hospital, (UCH), Ibadan , told the  court that he received a letter from Olufab Law Firm on March 25, to make a medical review on the medical report  from Mirabel Medical Centre, (a sexual assault referral centre at Lagos University Teaching Hospital), Ikeja, which was presented to the court by Akinbunmi.
 
Eze said the medical report presented did not meet the standard format in accordance with the forensic evaluation of sexual assault, as there was need for a qualified personnel to handle such medical examination.
   
When the witness was cross-examined by the lead state counsel, Mr. Babjide Boye, he told the court he did not charge for the consultancy service, adding that he reviewed the case due to public interest.
   
He said that he was not opportune to see the survivor and he did not have information as to the competence of the doctor.
 
Another witness, a friend of the defendant for 40 years, Mr. Oladende Bakare, who also testified,  told the court that Olaleye was not capable of committing the alleged crime.
   
While being cross-examination by Boye, the witness said he had never seen the survivor.
 
Bakare further said that he was not aware that the defendant had a sexual case in Britian and that he knew one Folake Ajanaku, the former wife of the defendant.

After listening to the counsel, Justice Oshodi adjourned to April 26, 2023, for further hearing.
